| dc.description.abstract | يعتبر موضوع تعديل الدستور من أهم المواضيع الحساسة في مجال القانون الدستوري وذلك لارتباطه المباشر والوثيق بالوثيقة الدستورية التي تعتبر أعلى وثيقة في البلاد يجب على السلطة الدستورية أن تلتزم بها. ويجب أن يتم وضعها مع الأخذ في الاعتبار الظروف السياسية والاقتصادية وحتى الاجتماعية والثقافية السائدة في البلاد. ولكن على الرغم من الجهود والدقة التي يبذلها المشرع عند طرحها إلا أنه قد تطرأ ظروف، قد تتطلب ضرورة تعديل الوثيقة الدستورية لتواكب تطورات الحياة الاجتماعية لكي تحدث فيها سد الثغرات التي قد تحدث فيها. وقد انتهت دراستنا إلى تسليط الضوء على أهم القيود التي فرضها المؤسس الدستوري الجزائري على السلطة المختصة بتعديل الدستور والتي يجب عليها أن تأخذها في الاعتبار اعتبارات القيود سواء كانت ذات طبيعة موضوعية أو جزائية.The subject of amend the constittution it is considered one of the most important sensitive topics in the filed of constitutional law, this is because of it’s direct and solide connection with the constitutional document which is considred the highest document in the contry which the constitional authority must be when puted taking into account political and economic circumstances and even the social and cultural one how’s previling in the contry. But although the efforts and precision of legislator when put it however it may happen circumstances, may arise that require the need to amend the constitutional document to keep pace with developments in social life On in order to occur therein fill the gaps wich may occur therin . Our study is it ended to highlight th most impotant restrictions set by the algerien constitutional founder to the authority competent to amend the constitution which she must take into account considred restrictions, wether of substantive or penal nature. | |
