| dc.description.abstract | إن موضوع دور الضحية في ارتكاب الجريمة يعد بشكل عام من المواضيع التي شغلت اهتمام علماء القانون الجنائي، وقد جاء هذا الاهتمام نتيجة لتطور الفكر الجنائي وعلم الضحايا الذي بدأ يهتم بضحايا الجريمة ويعزز مكانتهم القانونية. وفي هذا السياق تأتي هذه الدراسة في محاولة لتحديد أهمية الضحية وتوضيح دوره في الظاهرة الإجرامية، بمعنى أن علم الضحايا هو علم يدرس العلاقة القائمة بين الضحية والمجرم، والتي تتميز بعلاقتها بفروع مختلفة، ويتعرض الجاني لاستفزاز يدفعه إلى ارتكاب الجريمة. إضافة إلى ذلك فإن العقوبة هي العقوبة التي توقع على مرتكب الجريمة، وتتراوح أشكال العقوبة بين أصلية وتبعية، إلا أن الأخيرة تقدر وفق ضوابط، والدعوى تقام أصلاً من قبل النيابة العامة والمدعي المدني، ولها قيود يجب الالتزام بها.The topic of the role of the victim in committing crime is, in general, one of the topics that preoccupied criminal law scholars, and this interest came as a result of the development of criminal thought and victimology, which began to pay attention to victims of crime and strengthen their legal status. In this context, this study comes in an attempt to determine the importance of the victim and explain his role in the criminal phenomenon, meaning that victimology is a science that studies the relationship that exists between the victim and the criminal, which is characterized by its relationship to various branches, and the offender is exposed to provocation that prompts him to commit the crime. In addition, the penalty is the punishment that is imposed on the perpetrator of the crime, and the forms of punishment range between original and consequential, but the latter is estimated according to controls, and the case is originally initiated by the Public Prosecution and the civil plaintiff, and it has restrictions that must be adhered to. | |
