Abstract
وقامت الجزائر مؤخرا خلال مسيرة بناء دولة القانون بالارتقاء بقطاع العدالة وتحديثه من خلال مواءمته مع واقع العولمة وإدخال تكنولوجيا المعلومات والاتصال في تسييره، من أجل ضمان عدالة حديثة بمعايير دولية. . والتي كانت البداية فيها بصدور القانون رقم 03/15 المؤرخ في 1 فيفري 2015 المتعلق بتحديث القضاء والذي كان له الأسبقية في إدخال تقنية المؤتمرات المرئية في نطاق النيابة العامة حيث تم تعديل قانون الإجراءات الجزائية تلاه صدوره من الأمر رقم 20/04 المؤرخ في 30 أوت 2020 والذي أكد فيه المشرع الجزائري على ضرورة تفعيل نظام المؤتمرات المرئية، والذي نعتبره ركيزة أخرى في طريق تسريع النهوض بالقطاع.
إلا أن توجه المشرع نحو تعميم العمل بتقنية المؤتمرات المرئية أثار العديد من الإشكاليات القانونية نظرا لحجم انعكاسات هذه الرقمنة وأثرها على المبادئ الأساسية للمحاكمة العادلة.
Algeria had recently over the course of building the state of law to the uplifting of justice sector and modernize it through matching it up to globalization's realities and the introduction of information and communication technology in its conduct, in order to ensure a modern justice with international standards. In which the beginning was by the promulgation of Law No. 15/03 of 1 February 2015 on the justice's modernization which had the precedence to introduce the videoconferencing technique within the scope of public prosecution in which the amendments of Criminal Procedure's Code followed by the promulgation of Ordinance No. 20/04 of 30 August 2020, in which the algerian legislator confirmed the need of implementation a system of videoconferencing, which we consider another pillar on course to accelerate the enhancement of the sector.
However, the orientation of the legislator towards mainstreaming work by videoconferencing technique raised many legal problems due to the extent of this digitization's reflections and its effect on fundamental principles of the fair trial.
