| dc.description.abstract | تشديد العقوبة في حالة توافر الظروف القانونية التي تبرره معروفة ومفهومة و كذلك تخفيفها أما الجمع بينهما فهي فكرة تبدو للوهلة الأولى غير منطقية، فالقاضي الجزائي إما أن يتشدد فيرفع العقوبة الى الحد الذي يحدده القانون أو يتعاطف مع المتهم فيخففها الى الحد المسموح به قانونا أيضا، ومع ذلك أقر قانون العقوبات بإمكانية الجمع بينهما في حالة توافر ظرف العود الذي يلزم القاضي برفع العقوبة مع توافر ظروف قضائية مخففة للجريمة استعطفت المحكمة، فكيف يكون الجمع بين التشديد والتخفيف في تقدير العقوبة و ما هي ضوابطه؟ Tightening the penalty in the event that the legal conditions that justify it are known and understood, as well as mitigating it.
