Abstract
يعالج موضوع المسؤولية المدنية البيئية، ولا يزال، باهتمام كبير من المشرعين والقضاة وخبراء القانون، على الصعيدين الوطني والدولي، نظرًا لدوره الحيوي في حماية البيئة من التلوث. ورغم تزايد أهمية هذا المجال، إلا أن دراسته لا تزال حديثة نسبيًا، ويعود ذلك إلى التطورات المستمرة التي يشهدها، سواءً من حيث تحديد الأساس القانوني الذي ترتكز عليه هذه المسؤولية، أو تحديد المسؤول عن الضرر البيئي، أو تحديد الآليات المناسبة لتعويضه.The topic of environmental civil liability continues to receive considerable attention from legislators, judges, and legal experts, both nationally and internationally, due to its vital role in protecting the environment from pollution. Despite the growing importance of this field, its study remains relatively recent, due to ongoing developments, whether in terms of defining the legal basis upon which this liability is based, identifying those responsible for environmental damage, or determining appropriate mechanisms for compensation.
