dc.description.abstractتتناول هذه الأطروحة صلاحيات مجلس المنافسة في تنظيم السوق الجزائرية من خلال دوره في التصدي للممارسات المنافية للمنافسة، كما تبرز أهمية المجلس في حماية حرية المنافسة وضمان السير الحسن للسوق. وتتناول الأطروحة أيضاً الصلاحيات النزاعية للمجلس فيما يتعلق بالاتفاقات المنافية للمنافسة، موضحةً كيفية تدخل المجلس لمكافحة الاتفاقات التي تهدف إلى تقييد المنافسة أو تشويهها. وبالإضافة إلى ذلك، تناقش الدراسة الممارسات التعسفية التي قد يرتكبها المتعاملون الاقتصاديون، بما في ذلك إساءة استغلال الوضع المهيمن، والتبعية الاقتصادية، والتسعير الافتراسي. كما تبحث الدراسة في الصلاحيات غير النزاعية لمجلس المنافسة، ولا سيما مهامه الاستشارية والرقابية؛ إذ توضح دور المجلس في إبداء الرأي ومنع السلوكيات المنافية للمنافسة قبل وقوعها، وتؤكد على دوره في الرقابة على عمليات التركز الاقتصادي كوسيلة للحفاظ على التوازن التنافسي في السوق. وتخلص الأطروحة إلى أن مجلس المنافسة يُعد آلية جوهرية لضمان الشفافية والاستقرار وحماية الاقتصاد الوطني.This thesis examines the powers of the Competition Council in regulating the Algerian market through its role in addressing anti-competitive practices, highlighting the Council's importance in safeguarding the freedom of competition and ensuring the proper functioning of the market. The thesis also addresses the Council's adjudicatory powers regarding anti-competitive agreements, explaining how it intervenes to combat agreements aimed at restricting or distorting competition. Furthermore, the study discusses abusive practices committed by economic operators, including the abuse of a dominant position, economic dependency, and predatory pricing. The study also explores the non-adjudicatory powers of the Competition Council, particularly its advisory and supervisory functions; it elucidates the Council's role in issuing opinions and preventing anti-competitive conduct before it occurs, while emphasizing its role in monitoring economic concentration operations as a means of maintaining competitive balance in the market. The thesis concludes that the Competition Council serves as a vital mechanism for ensuring transparency and stability, as well as for protecting the national economy.
