| dc.description.abstract | إن مسألة توريث ذوي الأرحام أصبحت مشكلة حقيقية في ظل المعالجة القانونية الحالية لها، ولذلك كان من الأجدر وضع تصور يتم بمقتضاه منحهم حقوقهم، من خلال المقاربة الفقيهة التي أخذ منها المشرّع لصياغة المادة القانونية، ويكون ذلك عبر التركيز على ماهية ذوي الأرحام، وتحديد أصنافهم وطريقة توريثهم في الشّرع والتّشريع، من خلال دراسة تحليلية في الفقه الإسلامي وقانون الأسرة الجزائري، وظهور عدم الدقة في المادة القانونية التي نصّت على توريثهم، وإعطاء المال للخزينة العمومية، وهو ما يعتبر هضما للحقوق والذي يقتضي إعادة النّظر ليس في الفقه الإسلامي، بل في طريقة الاقتباس منه؛ من خلال عدم التجزئة والخلط مع مذاهب أخرى. The issue of inheritance of wombs has become a real problem in light of the current legal treatment of it, Therefore, it was better to develop a vision according to which they would be granted their rights, through the pious approach which the legislator took to formulate the legal article, This is by focusing on identifying those with wombs, and to identify their varieties and the way of their inheritance in Islamic law and legislation, through an analytical study of Islamic jurisprudence and the Algerian family law, and the appearance of inaccuracy in the legal article stipulating their inheritance, and giving money to the public treasury, which is considered a digestion of rights and which requires reconsideration not in Islamic jurisprudence, but in the way of quoting from it through non-fragmentation and confusion with other schools of thought. | |
