| dc.description.abstract | إن فكرة المحاكمة العادلة كمفهوم قانوني، لها وثيق الصلة بمجالات حقوق الإنسان، عرفها الفقه الإسلامي نصا وواقعا وتطبيقا، قبل أن يكتشفها المجتمع الإنساني وتقرها القوانين الوضعية، وقبل أن يتفق عليها المجتمع الدولي المعاصر ويعتمدها في وثائق ونصوص رسمية. وليس غريبا أن تعير شريعة الإسلام العناية اللازمة لكرامة المتهم وشخصيته باعتباره إنسانا كرمه الله عز وجل وأنزل من أجله الأحكام الدالة على هذا التكريم، وقد نبعت قواعد المحاكمة العادلة في الفقه الإسلامي من مكانة الإنسان ككائن بشري في ميزان القرآن الكريم، والسنة النبوية الشريفة، وفي أقوال علماء الأمة الإسلامية. ومن منطلق هذه المكانة السامية والدرجة الرفيعة تعين التعامل معه بما يليق وهذه المرتبة. The idea of a fair trial, as a legal concept, is closely related to the fields of human rights. Islamic jurisprudence defined it in text, reality, and application, before it was discovered by human society and approved by positive laws, and before the contemporary international community agreed on it and adopted it in official documents and texts. It is not surprising that the law of Islam pays due attention to the dignity and personality of the accused as a human being honored by God Almighty and for whom the provisions indicating this honor were revealed. The rules of a fair trial in Islamic jurisprudence stem from the human being’s status as a human being in the scales of the Holy Qur’an, the noble Sunnah of the Prophet, and in the sayings of Scholars of the Islamic nation.
