Abstract
تُعد الحماية الجنائية للمستهلك في التشريع الجزائري نهجاً متطوراً يرتكز على إرساء منظومة قانونية متكاملة تجمع بين الردع والعقاب من جهة، وضمان الفعالية الإجرائية من جهة أخرى. وقد اعتمد المشرع على ترسانة قانونية متنوعة، تشمل القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش، والقانون رقم 21-15 المتعلق بمكافحة المضاربة غير المشروعة، إلى جانب الأحكام العامة لقانون العقوبات؛ مما أتاح تغطية شاملة لمختلف صور الجرائم الماسة بالمستهلك، سواء التقليدية منها أو المستحدثة. كما عزز القانون رقم 25-14، المنظِّم للإجراءات الجزائية، هذه الحماية من خلال تنظيم مراحل الدعوى العمومية بشكل مفصل، بدءاً من المعاينة والحجز ووصولاً إلى تحريك الدعوى عبر آليات متعددة (الشكاوى، والشرطة القضائية، والهيئات الإدارية المختصة)، ومروراً بمرحلة التحقيق التي تتسم بالطابع التقني والاعتماد على التحاليل الفنية والاختبارات المخبرية. ويمنح القانون قضاة التحقيق صلاحيات واسعة في مجال جمع الأدلة واتخاذ التدابير الاحترازية، مع الحرص في الوقت ذاته على صون حقوق الدفاع. ويعكس هذا التكامل بين القوانين الموضوعية والإجرائية سعي المشرع إلى بناء نظام فعال لحماية المستهلك قادر على التصدي لممارسات الغش والمضاربة والتلاعب بالسوق، بما يحقق توازناً بين حماية المستهلك والاستقرار الاقتصادي.Criminal protection for consumers in Algerian legislation represents an advanced approach based on establishing an integrated legal framework that combines deterrence and punishment with procedural effectiveness. The legislator has employed a diverse legal arsenal—including Law No. 09-03 on consumer protection and the suppression of fraud, Law No. 21-15 on combating illicit speculation, and the general provisions of the Penal Code—thereby ensuring comprehensive coverage of various forms of consumer-related offenses, whether traditional or emerging. Law No. 25-14, governing criminal procedure, has further reinforced this protection by detailing the stages of public prosecution: from initial detection and seizure to the initiation of proceedings via various channels (complaints, judicial police, and competent administrative bodies), and through the investigation phase, which is characterized by its technical nature and reliance on expert analyses and laboratory testing. The law grants investigating judges broad powers to gather evidence and implement precautionary measures, while simultaneously safeguarding the rights of the defense. This integration of substantive and procedural laws reflects the legislator's aim to build an effective consumer protection system capable of countering fraud, speculation, and market manipulation, thereby striking a balance between consumer protection and economic stability.
