| dc.description.abstract | يعد الوالي هو الممثل الوحيد للدولة على مستوى الوالية، طبقا للمادة 110 من القانون رقم 07-12، التي تنص على » الوالي ممثل الدولة على مستوى الوالية، وهو مفوض الحكومة.« فالوالي يمثل صورة حقيقية لعدم التركيز الإداري الذي بمقتضاه عينت السلطة المركزية على المستوى المحلي ممثلين لها وفوضتهم سلطة البت النهائي في بعض الأمور دون الحاجة للرجوع إليها، غير أن هؤلاء الممثلين المعينين يمارسون سلطاتهم وصلاحياتهم تحت السلطة الرئاسية للسلطة المركزية، فيمارس الولاة سلطاتهم طبقا لما نص عليه قانون الولاية، والعديد من الصلاحيات و هذا بمساعدة مصالح الإدارة العامة للوالية ومجلس تنفيذي بالإضافة إلى صلاحية التمثيل القانوني للدولة أماما القضاء، كل هذه المهام التي يمارسها تخضع لرقابة إدارية و قضائية و تطبق عليه قواعد المسؤولية الجزائية و هذا تطبيقا لمبدأ المشروعية.The governor is the sole representative of the state at the wilaya level, according to Article 110 of Law No. 07-12, which states that “the governor is the state’s representative at the wilaya level and is the government’s commissioner.” The governor represents a true example of administrative decentralization, whereby the central authority has appointed representatives at the local level and delegated to them the authority to make final decisions on certain matters without the need to refer to it. However, these appointed representatives exercise their powers and authorities under the presidential authority of the central authority. The governors exercise their powers in accordance with what is stipulated in the wilaya law, and many of their powers are assisted by the wilaya’s general administration and an executive council, in addition to the authority to legally represent the state before the judiciary. All of these tasks that he exercises are subject to administrative and judicial oversight, and the rules of criminal liability apply to him, in application of the principle of legality. | |
