| dc.description.abstract | تبحث هذه المذكرة في الإطار المفاهيمي والقانوني لجريمتي الاتجار بالبشر والهجرة غير الشرعية، مبرزة آليات الحماية الجنائية في التشريع الجزائري والمواثيق الدولية. يقدم الفصل الأول تأصيلاً للمفاهيم والخصائص، مع تحليل التزامات الجزائر الدولية بروتوكول باليرمو والأساس التشريعي الوطني. بينما يركز الفصل الثاني على الجانب الإجرائي، مفصلاً آليات المتابعة، حماية الضحايا والشهود وسبل إعادة الإدماج كما تتناول الدراسة آليات ما بعد الأحكام، كطرق التعويض وجبر الضرر عبر الدعوى المدنية وصندوق التضامن الوطني، وصولاً إلى تقييم جهود المكافحة وطنيا ودولياً.This dissertation explores the conceptual and legal frameworks of human trafficking and illegal immigration, highlighting criminal protection mechanisms within Algerian legislation and international conventions. The first chapter establishes the conceptual boundaries and analyzes Algeria's international obligations (e.g., Palermo Protocol) alongside national legislative foundations. The second chapter focuses on procedural aspects, detailing prosecution mechanisms, victim and witness protection, and reintegration strategies. Furthermore, the study addresses post-judgment remedies, outlining compensation methods through civil action and the National Solidarity Fund, and evaluates national and international combating efforts. | |
