| dc.description.abstract | يُعتبر الوقف أحد أهم أوجه التبرّعات، وهو نظام مالي قائمٌ بذاته حظي باهتمامٍ من المشرّع الجزائري الذي أحاطه بجُملة من النّصوص من خلال قانون الأسرة، وكذا إفراده بقانون خاص، فضلا على بعض النّصوص الأخرى ذات الصّلة، وقد حرص المشرع على تحيينه بما يتماشى وتطور نسق الحياة المالية، بدليل التّعديل المتواتر لنصوصه، ورصد الحماية الجزائية والمدنية لنظامه، فكان لزاما أن يستوفي الوقف جُملة من الأركان التي ينبني عليها، والتي تبنّاها المشرّع الجزائري مُراعيا في ذلك الجوانب الشّرعية. فجاء هذا المقال لمعالجة هذه الأركان وفقا للمنظور التّشريعي ومراعاة الخلفية الفقهيّة، وما يستتبع ذلك من تدقيق في الشروط المتعلّقة بكلّ ركن، ليتحقق وجود الوقف شرعا، ولكي تترتّب عنه آثاره ومقاصده وأحكامه. Mortmain is one of the most important aspects of donations, a selfcontained financial system that received the attention of the Algerian legislator, who surrounded it with a number of texts through family law,and a private law, as well as some other relevant texts,the legislator was keen to revive it in line with the evolution of the financial life,as evidenced by the frequent amendment of its provisions, and monitoring the criminal and civil protection of its regime, so Mortmain must have fulfilled a number of pillars on which it rests,which was adopted by the Algerian legislator taking into account the legitimate aspects. This article came to deal with these pillars according to the legislative perspective and taking into consideration the jurisprudential background, and the consequent scrutiny of the conditions related to each pillar, so that the existence of Mortmain in sharia, in order to have its effects, purposes and provisions. | |
