Abstract
إن قضية حقوق المحبوس هي من قضايا العصر التي نالت حظا وافرا من اهتمام المجتمع الدولي، وقد صدرت في هذا الشأن العديد من المواثيق والاتفاقيات الدولية التي تضمن هذه الحقوق وتوفر لها الحماية اللازمة من خلال عدة آليات.
هذا وقد عملت الجزائر على تكريس حقوق المحبوس يقينا منها بأن ذلك يساهم في إصلاحه وإعادة تأهيله، وأحاطت هذه الحقوق بكافة الضمانات والآليات لاسيما الهيكلية منها التي تضمن حقيقة احترام هذه الحقوق وتجسيدها على أرض الواقع.
وعليه فإن هذه الدراسة تهدف إلى تسليط الضوء على بيان الآليات الهيكلية لضمان الحماية القانونية لحقوق المحبوس في ظل التشريع الجزائري سواءً على الصعيد الوطني أو الدولي، والوقوف أكثر على الدور المهم الذي تلعبه في تجسيد هذه الحماية على أرض الواقع.
The issue of the Prisoner's rights is one of the issues of the era that has received a great deal of attention from the international community, and many international conventions and agreements have been issued in this regard that guarantee these rights and provide them with the necessary protection through several mechanisms.
Algeria has worked to perpetuate its Prisoner's rights The imprisoned is convinced that this will contribute to his reform and rehabilitation, and these rights have taken in all the guarantees and mechanisms, especially the structural ones that guarantee the reality of respect for these rights and their embodiment on the ground.
This study aims to shed light on the statement of the structural mechanisms to ensure the legal protection of the rights of the detainee under the Algerian legislation, whether at the national or international level, and to stand more on the important role it plays in embodying this protection on the ground.
