| dc.description.abstract | لقد حضي القاصر في التشريع الج ازئري وعلى غرار باقي التشريعات الوضعية بعناية خاصة بالنظر إلى وضعه الحساس، حيث أنه وبسبب انعدام أو نقص أهليته، يتعذر عليه أن يباشر أموره المالية بنفسه، مما استوجب تعيين نائب شرعي لإدارة شؤونه المالية وحمايتها، وهذا الأخير وبالرغم من الدور المنوط به، إَلا أن المشرع لم يطلق سلطته، بل قيده وفق ضوابط قانونية تمنح للقاضي سلطة تقديرية في منح الاذن بالتصرفات التي تقتضيها ضرورة ومصلحة القاصر، ويتحمل من خلالها النائب الشرعي المسؤولية القانونية في حال تجاوز سلطته والإخلال بواجباته، وفقا لطبيعة ونوع الجريمة المرتكبة.Minors have received special attention in Algerian law, as in other positive legislation, given their sensitive situation. Due to their lack or incomplete capacity, they are unable to manage their financial affairs themselves. This requires the appointment of a legal representative to manage and protect their financial affairs. Despite the role assigned to them, the legislator has not unfettered their authority, but has restricted their authority according to legal controls that grant the judge discretionary power to authorize actions required by the necessity and interest of the minor. The legal representative bears legal responsibility in the event of exceeding their authority or failing to fulfill their duties, depending on the nature and type of crime committed. | |
