| dc.description.abstract | يعد الدليل العلمي المستمد من الوسائل العلمية الحديثة أداةً محوريةً في يد القاضي الجنائي لكشف الحقيقة وإثبات الجريمة. وقد ساهم التقدم العلمي والتكنولوجي في تطوير أساليب الإثبات، مما أدى إلى نتائج أكثر موضوعية. إلا أن هذا يُثير تساؤلات قانونية حول مشروعية الحصول على هذه الأدلة ومدى توافقها مع المعايير القانونية. فبعض أنواع الأدلة - مثل التنويم المغناطيسي، والتحليل المجهري، واعتراض الاتصالات، والتصوير الفوتوغرافي - تُمسّ مباشرةً بالحق في الخصوصية، مما يتعارض مع الحقوق الفردية المكفولة دستوريًا. ومع ذلك، فقد أجاز المشرع الجزائري استخدام هذه الأساليب، ولكنه قيد تطبيقها بمجموعة من الشروط الصارمة، تاركًا تقدير قيمتها الإثباتية لتقدير القاضي الجنائي، وفقًا لقناعته الشخصية، وبما يضمن احترام الشرعية الإجرائية.Scientific evidence derived from modern scientific methods is a pivotal tool in the hands of the criminal judge to uncover the truth and prove a crime. Scientific and technological progress has contributed to the development of evidentiary methods, leading to more objective results. However, this raises legal questions about the legitimacy of obtaining this evidence and its compliance with legal standards. Certain types of evidence—such as hypnosis, microscopic analysis, interception of communications, and photography—directly affect the right to privacy, thereby contradicting constitutionally guaranteed individual rights. However, the Algerian legislature has authorized the use of these methods, but has restricted their application to a set of strict conditions, leaving the assessment of their probative value to the discretion of the criminal judge, based on their personal convictions and ensuring respect for procedural legality. | |
