| dc.description.abstract | المحكمة الجنائية الدولية هي هيئة قضائية جنائية مستقلة دائمة جاءت لمعاقبة مرتكبي الجرائم الدولية الخطيرة المنصوص عليها في النظام الأساسي للمحكمة. تتم الملاحقة القضائية أمام المحكمة الجنائية الدولية من خلال ثلاث طرق حددتها المادة 13 من النظام الأساسي، أولاً المدعي العام، وهو المسؤول عن بدء إجراءات التحقيق والادعاء، ثانياً الدول الأطراف في النظام الأساسي للمحكمة، بالإضافة إلى ذلك إلى الاستثناء الوارد في المادة 12/3، وهي الدول غير الأطراف في النظام الأساسي للمحكمة الجنائية الدولية، وثالثاً، مجلس الأمن بموجب الفصل السابع من ميثاق الأمم المتحدة من خلال حفظ السلم والأمن الدوليينThe International Criminal Court (ICC) is an independent permanent criminal judicial body that came to punish the perpetrators of serious international crimes stipulated in the Statute of the Court. The prosecution before the ICC is initiated through three methods specified in Article 13 of the Statute, firstly, the Prosecutor, who is responsible for initiating the investigation and prosecution procedures, secondly, the States that are party to the Statute of the Court, in addition to the exception contained in Article 12/3, which are States not parties to the Statute of the ICC, and thirdly, the Security Council under Chapter 7 of the United Nations Charter through the maintenance of international peace and security . | |
