Were it not for the Algerian legislator's organization and arrangement of the rules governing the lives of individuals within society, widespread chaos would have ensued, everyone's rights would have been usurped, and crimes would have spread in terrifying forms, meaning the danger increases and worsens over time. Therefore, the law prohibits acts that infringe upon the freedom and physical and psychological integrity of persons. The Algerian legislator granted the victim the right to file a lawsuit before the Algerian judiciary to resolve the dispute legally and soundly, in order to achieve equality between the parties: the victim by recovering what was taken, and the accused by guaranteeing a fair trial that preserves their dignity and freedom within the limits permitted by law. Starting first with the procedures to be followed before the session begins, namely the composition of the Criminal Court, which consists of a judge, advisors, and four jurors. Subsequently, the legislator mandated that the case file reach the competent court before the trial begins. This occurs through three channels: the referral decision issued by the Indictment Chamber, the indictment issued by the Public Prosecution, or the files received from the Primary Criminal Court and the Supreme Court after cassation. Following this, the accused is transferred to the penal institution located within the jurisdiction of the Judicial Council where the Criminal Court is based. Furthermore, the Code of Criminal Procedure stipulates preparatory procedures that also precede the trial. These are divided into two types: standard and special procedures, and exceptional procedures. The legislator defined the latter with two measures: the supplementary investigation and the additional investigation, which are only conducted when necessity dictates. The fundamental and crucial stage encompasses the procedures during the trial itself. This involves interrogating the accused, hearing the defenses of the parties, and consulting experts and witnesses when required. All these procedures lead to the issuance of the judgment, which can be appealed before the Criminal Appeals Court for reconsideration, thereby applying the principle of two-tiered litigation
