| dc.description.abstract | يعتبر الطب مهنة انسانية نبيلة مكنت الانسان عبر التاريخ من التخلص من العلل والاختلالات رغم ذلك فهي مصدر لأضرار قد تكون خطيرة أحيانا مما جعلها في قفص الاتهام الجنائي والمدني والتأديبي ما بزوغ نزعة لمقاضاة ادارة المستشفيات وفق قواعد المسئولية الادارية التي لم تعرف لليوم استقرارا علي أسس وقواعد واضحة . هذه الوضعية بالإضافة لعدم تناظر المعرفة في العلاقة طبيب-مريض وعلاقة الصراع القائمة بين القضاء والطب وبين اسبقية التطور التكنولوجي أو الحفاظ علي الحقوق الأساسية كلها عوامل لجعل التوتر في مداه الأقصى مما يجعل الأخلاقيات الحيوية بديلا مهما بالإضافة لبدائل أخرى تسعى لدفع القانون والعلوم للقبول بدرجة من الاعتدال والتواضع يساهمان في خفض التوتر ورفع درجة مسئولية جميع الفاعلين في الحقل الطبي وصولا لنوع من العدالة والإنصاف كهدف سامي لجميع أفراد البشرية ولكل العلوم ولكل القانونيين. Medicine is a noble humanitarian profession that has enabled man.throughou this history.to alleviate ailments and functional imbalances.sometimes.it is at the origin of serious damage.wich has led to criminal .civil and disciplinary proceedings .with the emergence.of a tendency to sue the hospitals according to the rules of administrative responsibility.which has not yet been given stable and clear laws and rules. This situation.in addition to the asymmetry of knowledge between doctors and patients.the conflictual relationship between justice and medicine .the favor of technological development or the preservation of fundamental rights.are all factors in bringing tension to its maximum scope .making bioethics an important opportunity beyond other alternative and moving law and science with a scale of moderation and humility.contributing to reducing tensions and increasing the level of responsibility of all actors in the medical sector to achieve justice and aquity as the ultimate objective of all human beings.all sciences and all lawyers. | |
