| dc.description.abstract | تسعى المؤسسات الاقتصادية للحصول على التمويل اللازم للنمو وزيادة حجم نشاطها التجاري، لرفع نسبة أرباحها، إلا أن الصعوبة تثار في حالة عجز وضعها التجاري والمالي عن توفير القدر الكافي من وسائل التمويل، وضمان تحصيل الحقوق التجارية المستحقة تجاه عملائها، لأجل ذلك تعتبر مشكلة التمويل وعدم توفر الإمكانيات المادية مجالا خصبا لظهور بعض الوسائل العقدية غير التقليدية، التي تساهم في حل هذه المشكلة، ومن بين هذه العقود نجد عقد تحويل الفاتورة كمخرج مناسب لحل صعوبة التمويل Economic institutions seek to obtain the necessary financing to grow and increase the volume of their commercial activity, to raise their profits, but the difficulty arises in the event that their commercial and financial situation is unable to provide sufficient means of financing and to ensure the collection of commercial rights owed to their customers. For this reason, the problem of financing and lack of availability is considered The financial capabilities are a fertile field for the emergence of some unconventional contractual means, which contribute to solving this problem, and among these contracts we find the invoice transfer contract as an appropriate way out to solve the financing difficulty. | |
