| dc.description.abstract | يثير مفهوم العدالة الانتقالية العديد من التساؤلات بشأن مضمونها والآليات التي تنتهجها في تطبيق معاييرها بمختلف اتجاهاتها . إذ تسعى العدالة تحقيق المصالحة بشكل اساس بين الافراد و الدولة وفي حالات بين افراد المجتمع أنفسهم، ومن اهدافها الاساسية الاعتراف بما ارتكب من انتهاكات جسيمة لحقوق الانسان في فترة ما قبل الانتقال الديمقراطي، ودمج معاناة الضحايا ضمن الذاكرة الوطنية. للوصول الى حالة من الاستقرار والعيش المشترك في مجتمع الدولة المدنية دولة القانون ، والحرية والمساواة . لقد كانت العدالة الانتقالية واحدة من أهم العلامات الفارقة في عملية التحول الديمقراطي الذي شهده العراق بعد التغيير الذي حصل نتيجة الاحتلال الامريكي للعراق، من خلال جملة من القرارات التي اتخذتها سلطة الائتلاف المؤقتة، ومن بعدها مجلس الحكم، ومن ثم الحكومات التي تشكلت بعد العام 2005. The concept of transitional justice raises many questions about its content and the mechanisms by which it applies its standards in different directions. Justice seeks reconciliation primarily between individuals and the state, and in some cases among members of society themselves. Its main objectives are to recognize the grave human rights violations committed in the pre-transition period and to integrate the suffering of victims into the national memory to reach a state of stability and coexistence in a civil state state law, freedom and equality society. The paper proceeds from the premise that transitional justice was one of the most important milestones in the democratic transition in Iraq after the change that occurred as a result of the US occupation of Iraq through a series of decisions taken by the Coalition Provisional Authority, the Governing Council and then by the governments Formed after 2005. | |
