| dc.description.abstract | باعتبار أن الأحداث هم الفئة الأضعف في المجتمع، فهم بحاجة إلى رعاية نفسية وجسدية، مع مراعاة أعمارهم، الجنس والشخصية والتعرض للمؤثرات الخارجية. ولهذا السبب أولى المشرع الجزائري، كغيره من التشريعات، أهمية كبيرة لهذه الفئة. وبالإضافة إلى قانون العقوبات وقانون الإجراءات الجزائية، صدر لهما قانون متخصص وهو القانون رقم 15-12 الخاص بحماية الطفل. ويمنحهم هذا القانون الخصوصية في جميع مراحل الإجراءات القانونية، وليس ذلك فحسب، بل يوفر لهم الحماية في جميع مراحل التنفيذ. الهدف الأساسي للتشريع الجزائري في سياسته الجنائية الحديثة هو استبدال العقوبات التقليدية بتدابير لتحقيق أهدافه المتمثلة في الحماية والتسييس في المجتمع.Considering that juveniles are the weakest category in society, they need psychological and physical care, taking into account their age, gender, personality, and Vulnerability to external influences. That’s why the Algerian legislator, like other legislations, to give great importance to this category. In addition to the Penal Code and the Criminal Procedure Law, a specialized law was issued for them, which is Law 15-12 concerning the protection of the child. This law grants them privacy in all stages of legal proceedings, and not only that, but it also provides them with protection in all stage of implementation. The primary aim objective of Algerian legislation in its modern criminal policy is to replace traditional penalties with measures to reach its objectives of protection, politisation into society. | |
