| dc.description.abstract | توجه الجزائر نحو الإدارة الالكترونية في مرافقها أدى بالضرورة إلى عصرنة مرفق العدالة وذلك استجابة للتطور التكنولوجي والاستخدام المتزايد للانترنت في شتى المجالات. نهدف من خلال هذه الدراسة إلى تسليط الضوء في المبحث الأول على المحكمة الرقمية والمحكمة الإلكترونية وأهم مبررات التحول نحوهما وتداعيات هذا التحول المتمثلة في العيوب والتحديات التي تواجه كلا منهما. ثم التطرق إلى مظاهر بداية التحول نحو المحكمة الرقمية في الجزائر في المبحث الثاني ، وأهم نتيجة توصلنا إليها: أن المحكمة الجزائرية لم تصل بعد إلى وصف المحكمة الرقمية وإنما هي فقط محكمة إلكترونية، وبالتالي المحكمة الالكترونية تمثل أول خطوة من خطوات التوجه نحو المحكمة الرقمية التي تعتمد على تقنيات الذكاء الاصطناعي الذي يُستخدم في التقاضي الرقمي. Algeria has recently adopted the electronic governance in all facilities. This has necessarily led to the modernization of justice sector to meet the technological development and the increased use of internet in various domains. This study aims at shedding light on the digital court and the electronic one, the most important reasons behind this transformation and its results. We’ve firstly addressed the difficulties they faced. Then, we’ve tackled the aspects of the beginning of transformation towards the digital court. Finally, the most important attained result is that the Algerian court hasn’t yet achieved the total digitalization. It’s still an electronic court, which represents the first step towards the digital court that totally depends on the artificial intelligence techniques used in the digital litigation. | |
