| dc.description.abstract | زود المشرع الجزائري مجلس المنافسة بصلاحيات واسعة، الهدف منها الحفاظ على توازن السوق ووضعه التنافسي، ومن أجل ذلك يتدخل مجلس المنافسة تلقائيا عن طريق تقنية الإخطار الذاتي أو بعد إخطاره من الأطراف المحددة قانونا، وقد هدفت هذه الدراسة لاستجلاء الجوانب النظرية والعملية للإخطار التنازعي، أين تم التعرض للنصوص القانونية الناظمة لهذا الأخير، وبعض القرارات الصادرة عن مجلس المنافسة من أجل الإحاطة بكيفية سير الإخطار ومعالجته من طرف مجلس المنافسة والكشف عن النقائص المسجلة في هذا الإطار. The algerian legislator provided the competition council with broad powers aimed at maintaining the market’s balance and competitive position, to this end, the competition concil automatically intervenes by means of a self-notification technique or after being notified by the legally determined parties conceptual and pratical aspects or contencious notification, where has the legal texts governing the latter been exposed, and some decisions of the competition council to inform how the notification has been conducted and addressed by the competition council and to detect the shortcomings recorded in this context. | |
