Abstract
إن عرض وتحليل مضمون الحماية التشريعية للبيئة الطبيعية ضد مخاطر وأضرار التلوث البيئي، وبمعنى أخر دراسة الحماية القانونية المدعمة بالجزاءات الجنائية وغير الجنائية ضد كل مساس بعناصر البيئة الطبيعية، والبحث في الأحكام التشريعية الخاصة بالأركان العامة لجرائم تلويث البيئة، والمسؤولية الجنائية لمرتكبي تلك الجرائم، والجزاءات المقررة لردعهم، يقتضى في البداية تحديد المقصود بجرائم تلويث البيئة الطبيعية، وذلك من خلال البحث في المدلول القانوني لهذا النوع من الجرائم والخوض في أهم الجوانب المتعلقة بعناصر الجريمة البيئية، والتطرق إلى نطاق المكافحة القانونية لتلك الجرائم على صعيد التشريعات الداخلية للدول، وهي الجوانب التي تم استعراضها في هذه الدراسة.
presentation and analysis of the content of the legislative protection of the natural environment against the dangers and harm of environmental pollution, in other words the study of the legal protection supported by criminal and non-criminal sanctions against any harm to the elements of the natural environment and research into legislative provisions concerning the general elements of environmental pollution offenses and the criminal liability of criminals, this through research on the legal signifier of this type of offense and the debate on the important aspects concerning the elements of the environmental offense and the discussion of the field of legal fight against these offenses on the level of internal legislations of the states, all these represent the aspects presented in this study.
