Abstract
يُعدّ اختصاص المحكمة الجنائية الدولية أحد الركائز الأساسية لضمان العدالة الجنائية الدولية. فهو يُحدد الإطار القانوني الذي يُمكّنها من النظر في القضايا المتعلقة بأخطر الجرائم التي تُثير قلق المجتمع الدولي، وهي: الإبادة الجماعية، والجرائم ضد الإنسانية، وجرائم الحرب، وجريمة العدوان. ويخضع هذا الاختصاص لمجموعة من الشروط القانونية التي تهدف إلى ضمان احترام مبدأ التكامل مع النظم القضائية الوطنية ومنع تسييس العدالة الدولية. وتمارس المحكمة اختصاصها بناءً على إحالة من دولة طرف، أو من مجلس الأمن التابع للأمم المتحدة، أو بمبادرة منها من خلال المدعي العام، شريطة استيفاء شروط الاختصاص الموضوعي والزماني والإقليمي والشخصي. ويمنح هذا الإطار القانوني المتهمين ضمانات قانونية متعددة من خلال إجراءات محاكمة عادلة، بما في ذلك الحق في الدفاع والاستئناف والمراجعة أمام مختلف دوائر المحكمة، مما يعكس الرقابة القضائية الدولية على شرعية الإجراءات ويساهم في مكافحة الإفلات من العقاب.The jurisdiction of the International Criminal Court (ICC) is considered one of the fundamental pillars for ensuring international criminal justice. It defines the legal framework that allows the Court to examine cases involving the most serious crimes of concern to the international community, namely: genocide, crimes against humanity, war crimes, and the crime of aggression. This jurisdiction is subject to a set of legal conditions aimed at ensuring respect for the principle of complementarity with national judicial systems and preventing the politicization of international justice.
The Court exercises its jurisdiction based on a referral by a State Party, the United Nations Security Council, or on its own initiative through the Prosecutor, provided that the conditions for subject-matter, temporal, territorial, and personal jurisdiction are met. This legal framework grants defendants several legal guarantees through fair trial procedures, including the right to defense, appeal, and review before the various chambers of the Court, thereby reflecting international judicial oversight over the legitimacy of the proceedings and contributing to the fight against impunity.
