| dc.description.abstract | تناولنا في هذه المذكرة دراسة الجرائم الانتخابية في التشريع الجزائري، من خلال بيان مفهوم الجريمة الانتخابية وخصائصها وأنواعها، وتحديد الجرائم الانتخابية والعقوبات المقررة لها، يعتبر الانتخاب الدعامة الأساسية للديمقراطية، كونه المرجعية الأساسية في تحديد شرعية السلطة داخل المجتمع، وهو الأداة المثلى في تجسيد مفهوم السيادة الشعبية، ولتحقيق انتخابات تعبر عن الإرادة السليمة للهيئة الناخبة، أحاط المشرع الانتخابي العملية الانتخابية بمجموعة من الضمانات التي تحفظ لها نزاهتها وحسن سيرها في مختلف مراحلها. إن الجرائم الانتخابية متعددة فقد نظمها المشرع الجزائري في قانون العضوي رقم 10-21 المنظم للانتخابات المعدل والمتمم بالقانون العضوي08-19 وكذا قانون رقم 66-165 المتضمن قانون العقوبات المعدل والمتمم، وبالموجب قانون الوقاية من الفساد ومكافحته رقم 06-01.In this memorandum, we deal with the study of electoral crimes in Algerian legislation, by clarifying the concept of electoral crime and the mechanism for monitoring it, along with specifying the electoral crimes and the penalties prescribed for each of them. The Election considered as a basic base for the democratic, as it is the basis for the embodiment of the concept of popular sovereignty, to realize election that show the right will of elective body, there must have been guarantees to preserve the integrity and integrity of the electoral process and to improve its functioning at all stages. The electoral crimes are numerous and regulated by the legislator in the Organic Law N deg 21-10 related to the elections amended and supplemented by the Organic Law N deg 19-08 in Chapter Seven under the title of Penal Provisions from Article 197 to Article 223, as well as the penal CodeN 66-156 amended and supplemented, and under the prevent ion of Corruption Law And counter N06-01 | |
