| dc.description.abstract | تتناول هذه الدراسة الإطار القانوني المنظم لوضعية التاجر الأجنبي في التشريع الجزائري، باعتباره موضوًعا يعكس توازن الدولة بين الإنفتاح على الاستثمار الأجنبي وحماية االقتصاد الوطني. وقد بّينت النتائج أن غياب نصوص موحدة ومتكاملة يُربك وضع التاجر األجنبي ويخلق ثغ ارت قانونية محتملة، في حينُ يفرض على بعض الأنشطة الاقتصادية قيود تتعلق بالسيادة، ما قدُيضعف جاذبية الاستثمار. كما أظهرت الد ارسة تفاوتًا في المعاملة القانونية بين التاجر الوطني والأجنبي، ما يتطلب مراجعة دقيقة لمنظومة القوانين ذات الصلة. وفي ضوء هذه الملاحظات، قدمت الدراسة جملة من التوصيات أبرزها: تبسيط اإلجراءات االادارية، توحيد النصوص القانونية، وتحقيق توازن بين متطلبات الاقتصاد الوطني وضمان حرية التجارة. تسعى هذه الدراسة إلى إثراء النقاش األكاديمي حول التاجر الاجنبي في الجزائر، وتوفير أرضية قانونية تساعد صناع القرار في تحسين مناخ الاستثمار وفًقا لمبادئ السيادة الاقصادية والانفتاح العقلاني This study examines the legal framework regulating the status of foreign traders in Algerian legislation, as a topic that reflects the state's balance between openness to foreign investment and protection of the national economy. The results revealed that the absence of unified and comprehensive texts confuses the status of foreign traders and creates potential legal loopholes. Meanwhile, sovereignty-related restrictions are imposed on some economic activities, potentially weakening investment attractiveness. The study also revealed a disparity in legal treatment between national and foreign traders, which requires a careful review of the relevant legal system. In light of these observations, the study presented a set of recommendations, most notably: simplifying administrative procedures, unifying legal texts, and achieving a balance between the requirements of the national economy and ensuring freedom of trade. This study seeks to enrich the academic debate on foreign traders in Algeria and provide a legal framework that helps decision-makers improve the investment climate in accordance with the principles of economic sovereignty and rational openness. | |
