| dc.description.abstract | لاستقالة تُعد من المواضيع البارزة في قانون الوظيفة العمومية، لِما لها من أثر مباشر على العلاقة بين الموظف والإدارة. فهي الأداة القانونية التي يُعبّر بها الموظف عن رغبته في إنهاء خدمته طوعا. وقد نظمها المشرع الجزائري في القانون 06 - 03 بما يضمن تواز نا بين حرية الموظف في الاستقالة ومتطلبات استمرارية المرفق العام. ولحماية حقوق الطرفين، فرض القانون إج ا رءات وضوابط، كضرورة تقديم طلب كتابي وانتظار قرار الإدارة بالقبول. ويهدف هذا التنظيم إلى التوفيق بين المصلحة الخاصة للموظف والمصلحة العامة، بما يضمن حسن سير الم ا رفق دون المساس بحقوق الأفراد.Resignation is a prominent topic in the Civil Service Law, due to its direct impact on the relationship between the employee and the administration. It is the legal instrument by which an employee expresses his or her desire to voluntarily terminate his or her service. Algerian legislators have regulated it in Law 06-03, ensuring a balance between the employee's freedom to resign and the requirements for the continuity of the public service. To protect the rights of both parties, the law imposes procedures and controls, such as the requirement to submit a written request and await the administration's decision to accept it. This regulation aims to reconcile the employee's private interest with the public interest, ensuring the smooth running of the service without infringing on the rights of individuals. | |
