Abstract
يتحد العنصر الذي تستهدفه الجماعات الارهابية من خلال السبي و تهريب البشر، و يتمثل في الحرية التي تعد عنصرا جوهريا و أساسيا و ساميا في الكينونة الآدمية لارتباطه بالعقل الذي هو مناط الاختيار الذي فطره الله في الانسان. و لضرب هذا العنصر بما يمثله من أساسيات الطبيعة البشرية تعمد الجماعات الارهابية لتبرير ذلك بإعطائه صبغة دينية من خلال نشر و اشاعة بعض الآراء الفقهية دون التدقيق في درجة رجحانها ويتعلق الامر أساسا بموضوعين أساسيين يحكمان عنصر الحرية الانسانية و هما السبي و الاسترقاق. إضافة لما سبق نجد أن أحكام الأسرى لدى هذه الجماعات قد انحرفت بها سواء على مستوى مشروعية الحرب التي يزعمونها ابتداء، أو على مستوى معاملتهم لما يسمونهم أسرى التي حسمها القرآن الكريم بطريقتي المن –إطلاق السراح-، أو الفداء بعيدا عن التصفيات الجسدية أو البيع في سوق النخاسة بما يتنافى مع القيم الانسانية .
The element that terrorist groups target through captivity and human smuggling is freedom, which is a fundamental and supreme element of the human being ,because of its attachment to the mind which is the means of choice that God has instilled in man. In order to strike this element wich is the basic of human nature, terrorist groups deliberately justify this by giving it a religious character by disseminating some doctrinal opinions without scrutinizing the degree of its credibility. This is mainly related to two basic issues governing the element of human freedom, namely, captivity and slavery. In addition to the above, we find that the prisoners' judgments in these groups have deviated both at the level of the legality of the war they claim, or at the level of their treatment of the so-called prisoners that the Holy Quran has determined in two ways: release, or redemption, away from physical liquidation or sale in a slave market that contradict human values.
