| dc.description.abstract | يقوم القضاء الدولي الجنائي بمحاكمة الأشخاص المتهمين بارتكاب جرائم دولية ، يعاقب عليها القانون الدولي أمام المحكمة الجنائية الدولية بموجب نظامها الأساسي، وعند إصدار أحكام قضائية وجب تنفيذها على ارض الواقع حتى يكون المحكوم عليه بصفة نهائية عبرة لغيره، من أجل الحد من انتهاكات القانون الدولي الإنساني مستقبلا. إلا أن تطبيق هذه الأحكام القضائية يحتاج للكثير من الإمكانيات المادية وأهمها مكان تنفيذ العقوبة، حيث أن المحكمة لا تملك مكان مخصص لها لتنفيذ هذه الأحكام، مما جعل تنفيذها يكون في دول أخرى وهو ما أثر تطبيق القانون الدولي الإنساني، إيجابيا وسلبيا، وبالتالي التأثير على تحقيق السلم و الأمن الدوليين في العالم. The international criminal judiciary tries persons accused of committing international crimes punishable by international law before the International Criminal Court in accordance with its statute, and when judicial rulings are issued that must be executed on the ground so that the final convict is a lesson to others, in order to reduce violations of international humanitarian law in the future .
