| dc.description.abstract | وتماشيا مع تطور السياسة الجنائية الحديثة، سعى المشرع الجزائري إلى مواكبة هذا التطور العالمي من خلال إدخال إجراءات الوساطة الجنائية كبديل للملاحقات التقليدية، وذلك بموجب الأمر 15-12 والأمر 15-02 لتجنب التعقيدات المتعلقة بإجراءات التقاضي. .وهي آلية اختيارية يمنحها المشرع للنائب العام لإنهاء الدعوى العامة والوصول إلى حل يرضي أطراف النزاع دون اللجوء إلى أروقة العدالة. تهدف الوساطة بشكل رئيسي إلى تقليل حجم المنازعات التي تثقل كاهل القضاء، وتتميز بالتسوية السريعة للقضايا المطروحة، فضلا عن تحقيق مبدأ الاتفاق التوافقي بين أطراف النزاع مما يوفر الوقت والكثير من النفقات .ويبدو أن المشرع الجزائري قد وافق إلى حد ما على إدراج آلية لحماية الأسرة من التفكك والاضطراب الناتج عن الجريمة، والعمل على تعويض الضرر الذي لحق بالضحية وإعادة تأهيل المتهم وإعادة إدماجه بشكل ودي. دون الحاجة إلى الملاحقة الجنائية، بالإضافة إلى الحفاظ على المجتمع من خلال تجنيبه الأحقاد وحماية أفراده من الانحراف. In line with the development of modern criminal policy, the Algerian legislator sought to keep pace with this global development by introducing criminal mediation procedures as an alternative to traditional prosecutions, under order 15-12 and order 15-02 to avoid complications related to litigation procedures.It is an optional mechanism granted by the legislator to the public prosecutor to end the public lawsuit and reach a solution that satisfies the parties to the dispute without resorting to the corridors of justice. Mediation mainly aims to reduce the volume of disputes that burden the judiciary, and is characterized by the rapid settlement of the issues raised, as well as achieving the principle of consensual agreement between the parties to the dispute, which saves time and a lot of expenses.It seems that the Algerian legislator has agreed to some extent to include a mechanism to protect the family from disintegration and turmoil resulting from the crime, and works to compensate the harm suffered by the victim and to rehabilitate the accused and reintegrate him in a friendly manner without the need for criminal prosecution, in addition to preserving society by sparing him grudges and protect its members from deviation. | |
