Abstract
يعد موضوع انعدام وبطلان القرار الإداري من أهم مباحث القانون الإداري، حيث يرتبط بمدى مشروعية أعمال الإدارة. فالبطلان يطرأ على القرار الإداري عندما يشوبه عيب من عيوب المشروعية، كعدم الاختصاص أو مخالفة الشكل أو السبب أو الانحراف في استعمال السلطة، فيبقى القرار قائماً ومنتجاً لآثاره إلى أن يتم إلغاؤه قضائياً ضمن آجال محددة. أما الانعدام فيمثل درجة أشد من عدم المشروعية، إذ يفقد القرار أحد أركانه الأساسية، كصدوره عن جهة منعدمة الاختصاص أو افتقاده لمحل قانوني، مما يجعله كأن لم يكن منذ صدوره ولا يرتب أي أثر قانوني، ويجوز الطعن فيه في أي وقت دون التقيد بآجال، وبذلك يتمثل الفرق الجوهري بينهما في أن القرار الباطل يحتاج إلى حكم قضائي لإزالته، بينما القرار المنعدم يعد معدوما قانونا منذ البداية ويقتصر دور القضاء على التصريح بانعدامه.The issue of nullity and inexistence of administrative decisionsis a fundamental topic in administrative law, as it relates to the legality of administrative actions. Nullity arises when an administrative decisionisaffected by a legaldefect, such as lack of competence, proceduralirregularities, defects in reason or purpose, or misuse of power; in this case, the decisionremainsvalid and produceslegaleffectsuntilitisannulled by a court withinspecified deadlines. In contrast, inexistence represents a more seriousillegality, occurringwhen the decisionlacks one of its essential elements, such as beingissued by a manifestlyincompetentauthority or having no legal basis, whichrendersit as if itneverexisted and produces no legaleffects;therefore, itmaybechallenged at any time without limitation periods. The fundamentaldifference lies in the factthat a voidabledecisionrequiresjudicialannulment to ceaseitseffects, whereas an inexistent decisionislegally non-existent from the outset and onlyrequires a judicialdeclaration of its inexistence
