| dc.description.abstract | يُعالج هذا البحث موضوعا جديدا نسبياّ يتمثّل في أحكام القانون رقم (15-01) المتضمّن إنشاء صندوق النّفقة، بين النّص القانوني والتّطبيق العملي، والذي جاء استحداثه في الجزائر كما هو الحال في بعض الدّول العربية، ويتولى وفق إجراءات محدّدة دفع مبالغ النّفقة للدّائنين ممثّلين في المرأة المطلّقة وأبنائها المحضونين، ويحرص على استرجاع هذه الأموال من المدينين، حيث يصبح الصّندوق دائنا في مواجهة المدين بالنّفقة، وإبقاء المتابعة الجزائية سارية المفعول في حقّه، وبالرّغم من الهدف الإنساني الذي يهدف الصّندوق إلى تحقيقه وهو كفاية فئة محدّدة في المجتمع ماديا، إلاّ أنّ ذلك أثبت قصوره من خلال استبعاده للزّوجة والأصول من الاستفادة، وهو ما يرهن دوره في الحفاظ على النّسيج الأسري وتماسك المجتمع. This research treats with a relatively new subject, which is the provisions of Law No(15-01 ), it includes the establishment of the Alimony Fund, Between legal text and practical application, which was introduced in Algeria as is the case in some Arab countries, and according to specific procedures, it pays the alimony amounts to creditors represented by divorced women and their children; and is keen to recover these funds from debtors, Where the Fund becomes a creditor in the face of the debtor, with the maintenance of Criminal follow-up in his right, In spite of the human objective that the Fund aims to achieve is the adequacy of a specific group in the society materially, but this proved its shortcomings by excluding the wife and assets from the benefit, which bet his role in preserving the family fabric and cohesion of society. | |
