| dc.description.abstract | تتميز الدعوى المستعجلة عن غيرها من أشكال التقاضي من حيث موضوعها والإجراءات المتنازع عليها في مرحلة رفع الدعوى وشروط قبولها وكذلك نوع الحكم الذي يكون قابلا للتنفيذ الفوري رغم إمكانية الاستئناف وهو ما يتسم بطبيعة خاصة. الحماية القضائية المنصوص عليها في قضايا هذا النوع من الاستعجال هي أداة قضائية يلجأ إليها المدعون لحماية حقوقهم من الأخطار المحتملة حيث أن الحقوق لا تكتمل أركان وجودها إذا عجز صاحبها عن حمايتها ولم يكن هناك من سبيل لحمايتها أثناء النزاع وقد جعل المشرع الجزائري القضاء المستعجل الذي تقتصر صلاحياته على الأحكام في الدعاوى الوقتية إلى حين تنازع الأطراف المعنية على إقامة الحق أمام القضاء وذلك لتقريب القضاء من المواطن وهو ما أحدثه المشرع في قوله بتحقيق حماية أكبر لمصالح الشخص فقد أحدث المشرع الجزائري القضاء المستعجل على المستوى القطاعي للنظر في القضايا ذات الطبيعة المستعجلةUrgent lawsuits are distinguished from other forms of litigation in terms of their subject matter, the disputed procedures at the stage of filing the lawsuit, the conditions for its acceptance, and the type of judgment that is immediately enforceable despite the possibility of appeal, which is characterized by a special nature. The judicial protection provided for in cases of this type of urgency is a judicial tool that plaintiffs resort to to protect their rights from potential dangers, as rights are not complete if their owner is unable to protect them and there is no way to protect them during the dispute. The Algerian legislator has made the urgent judiciary, whose powers are limited to rulings in temporary lawsuits until the parties concerned dispute the establishment of the right before the judiciary, in order to bring the judiciary closer to the citizen, which is what the legislator has created in his statement to achieve greater protection for the interests of the person. The Algerian legislator has created the urgent judiciary at the sectoral level to consider cases of an urgent nature. | |
