Abstract
اصبح التفويض العام نظامه القانوني الخاص الذي يميزه عن العديد من مفاهيم وأساليب الإدارة الأخرى، وذلك نتيجةً لتزايد وظائف وأنشطة المرافق العامة، والقانون الخاص في إطار القانون، وذلك على نفقتها ومسؤوليتها، مقابل الحصول على مورد مالي من المستفيدين في شكل إتاوات. وقد نظم المشرع الجزائري عقود تفويض المرافق العامة بوضوح، وذلك بموجب المرسوم الرئاسي رقم 15-247 الذي وحد جميع أنواع التفويضات في نص واحد، ثم جاء المرسوم التنفيذي رقم 18-199 ليُقدم مفهومًا جديدًا للتعاقد الإداري، مميّزًا الشراكة بين القطاعين العام والخاص.Public delegation has acquired its own legal system, distinguishing it from many other management concepts and methods. This is due to the increasing functions and activities of public utilities, and the private law within the framework of the law, at their expense and responsibility, in exchange for a financial resource from beneficiaries in the form of royalties. Algerian legislators clearly regulated public utilities' delegation contracts, pursuant to Presidential Decree No. 15-247, which unified all types of delegations into a single text. Executive Decree No. 18-199 then introduced a new concept of administrative contracting, distinguishing the partnership between the public and private sectors.
