| dc.description.abstract | وعلى الرغم من تطبيق العقوبات الحرمانية على جرائم مختلفة، إلا أنها لا تعتبر وسيلة حقيقية للحد من ارتكاب الجريمة، وذلك نظرا للآثار السلبية التي ترتبت على السياسة الاحتجازية التقليدية للحرية، وخاصة القصيرة الأجل، من جميع النواحي. سواء على المحكوم عليه أو المجتمع أو الدولة. وبالإضافة إلى تناقضها وهدف السياسة الحديثة، فإن السياسة الجنائية يجب أن تتجه إلى اعتماد الأنظمة العقابية الحديثة، والتي تعرف بالعقوبات البديلة السالبة للحرية، وذلك في إطار تحديث السياسة الجزائية بهدف مكافحة الجريمة والحد من انتشارها. مما من شأنه إصلاح المحكوم عليه وإعادة دمجه في المجتمع. تساعد العقوبة البديلة على إبعاد المحكوم عليه عن الاتصال بالمجرمين الخطرين في المؤسسات العقابية وتتيح فرصًا جديدة لتجنب الانحراف، كما تمنعه من العودة إلى الجريمة. Although deprivation punishments are implemented for various crimes, they are not considered a real way to reduce crime commitment, and in view of the negative consequences that have resulted from the traditional custodial policy of deprivation of liberty, especially short-term ones, in all respects, whether on the convict, society, or the state. In addition to its contradiction and the goal of modern policy, criminal policy must turn to adopting modern penal systems, which are known as alternative punishments of deprivation of liberty, within the framework of modernizing penal policy with the aim of combating crime and limiting its spread, which would reform the convict and reintegrate him into society. Alternative punishment helps keep the convict away from contact with dangerous criminals in penal institutions and provides new opportunities to avoid deviance, as well as prevent him from returning to crime | |
