| dc.description.abstract | تُعتبر الحضانة وسيلة ضرورية لرعاية المحضون بعد انفصال الوالدين، ولذلك حرص قانون الأسرة الجزائري على تنظيمها من خلال العديد من المواد التي بيّنت تفاصيلها، والتي نصّت على ضرورة مُراعاة مصلحة المحضون، وعملت المحكمة العليا وفق وظيفتها الاجتهادية على معالجة هذه المسألة بما للقاضي من سُلطات في تقريرها، دون تعيين لحدود هذه السّلطة التي تمسّ العديد من الجوانب الخاصّة بالمحضون حرصا على تحقيق مصلحته. غير أنّ قراراتها شابها التّناقض في العديد من المواضِع من خلال سُلطة القاضي التي قد تصل إلى حدّ التعسّف في إعطاء الحضانة أو إسقاطها، الأمر الذي يؤدّي إلى الإضرار بمصلحة المحضون عوضًا عن حمايتها.
