| dc.description.abstract | تناولت هذه الدراسة موضوع الرقابة القضائیة على القرارات الإداریة ضمن النظام القانوني الجزائري، مسلطًا الضوء على دور القضاء في فرض التزام الإدارة بمبدأ المشروعیة في كل قراراتها وأعمالها، سواء في الظروف العادیة أو الطارئة .بدأت الدراسة بمبحث تمهیدي عرضت فیه المفاهیم الأساسیة المتعلقة بالقرار الإداري والرقابة القضائیة، وتبعه الفصل الأول الذي استعرض بالتفصیل الأركان الأساسیة للقرار الإداري .تم فیه تحلیل العیوب الشكلیة والموضوعیة التي قد تطرأ على القرار، مثل عیب عدم الاختصاص، عیب الشكل، عیب المحل، السبب، وعیب الغایة .شدد هذا الفصل على توضیح كیفیة تدخل القضاء لضمان صحة وقانونیة القرارات الإداریة .تناول الفصل الثاني الأعمال الإداریة على استخدامها. كما عالج هذا الفصل الرقابة القضائیة في الظروف الاستثنائیة مثل المستثناة من الرقابة القضائیة، مبرزا السلطة التقدیریة للإدارة والقیود القضائیة المفروضة الكوارث أو التهدیدات الأمنیة، حیث تُمنح الإدارة سلطات خاصة لضمان استمراریة المرافق العامة، مع الحفاظ على توازن بین السلطة والرقابة. لدعم التحلیل وتعزیز الدقة العلمیة والقانونیة، اعتمدت الدراسة على مجموعة متنوعة من المصادر الفقهیة والنصوص القانونیة والدراسات الأكادیمیة والأحكام القضائیة، فضلاً عن إجراء مقارنات دقیقة في بعض جوانب البحث .اختتمت الدراسة بالنتیجة أن الرقابة القضائیة على القرارات الإداریة تعتبر أداة أساسیة لتحقیق مبدأ المشروعیة وضمان التوازن بین حمایة حقوق الأفراد وكفاءة الإدارة، حتى في الظروف الاستثنائیة التي تتطلب تكییف القواعد القانونیة لتحقیق المرونة دون المساس بمبادئ العدالة والمشروعیةThis study addresses the topic of judicial oversight of administrative decisions within the Algerian legal system, highlighting the role of the judiciary in enforcing the administration's commitment to the principle of legality in all its decisions and actions, whether in normal or emergency circumstances. The study began with an introductory section in which the basic concepts related to administrative decisions and judicial oversight were presented, followed by the first chapter, which reviewed in detail the basic pillars of the administrative decision. It analyzed the formal and substantive defects that may arise in the decision, such as the defect of lack of jurisdiction, defect of form, defect of subject matter, cause, and defect of purpose. This chapter emphasized clarifying how the judiciary intervenes to ensure the validity and legality of administrative decisions. The second chapter addressed administrative actions and their use. This chapter also addresses judicial oversight in exceptional circumstances, such as those exempt from judicial oversight, highlighting the discretionary power of the administration and the judicial restrictions imposed by disasters or security threats. The administration is granted special powers to ensure the continuity of public services, while maintaining a balance between authority and oversight. To support the analysis and enhance scientific and legal accuracy, the study relied on a variety of jurisprudential sources, legal texts, academic studies, and judicial rulings, as well as conducting careful comparisons in some aspects of the research. The study concludes that judicial oversight of administrative decisions is an essential tool for achieving the principle of legality and ensuring a balance between protecting individual rights and administrative efficiency, even in exceptional circumstances that require adapting legal rules to achieve flexibility without compromising the principles of justice and legality. | |
