Abstract
شهدت الجزائر انتشار العديد من صور المضاربة غير المشروعة خلال أزمة كورونا، حيث استغل
المضاربون هذه الأزمة من أجل تحقيق مكاسب مادية هائلة على حساب المواطنين، مما أجبر السلطات
15 - الجزائرية على التدخل بإصدار القانون الرادع والصارم، والذي تمثل في القانون في رقم 21
بمكافحة المضاربة غير المشروعة لمواجهة كل صور المضاربة غير المشروعة التي تهدف إلى إحداث
ندرة أو اضطراب في السوق، وقد جاء هذا القانون بمجموعة من الآليات التي تركز على منع جميع
صور المضاربة غير المشروعة، وتمثلت هذه الآليات في الآليات الاجرائية في تعزيز تدخل الدولة أو
الجماعات المحلية، وتفعيل دور المجتمع المدني أو وسائل الإعلام، فضلا عن الآليات القواعد
الموضوعية، كما وضع هذا القانون مجموعة من الآليات العقابية التي تضمنت عقوبات أشد من العقوبات
المنصوص عليها في قانون العقوبات سواء تعلق الأمر بالعقوبات الأصلية أو التكميلية بالنسبة للشخص
