| dc.description.abstract | تهدف هذه الدراسة إلى تسليط الضوء على دور محاكم الدرجة الثانية في تحقيق التوازن داخل النظام القضائي الجزائري وذلك من خلال تحليل مختلف الأطر القانونية التي تنظم سيرها وتوضح نطاق اختصاصها وإبراز أهميتها في تحقيق التوازن مع الهيكل القضائي في النظام العادي، حيث يعتبر استحداث هذه الهيئة الجديدة من أبرز التطورات التي مست مجال الإصلاح القضائي الإداري وخطوة مهمة نحو ترسيخ فكرة دولة الحق والقانون سيما أن وجود هذه المحاكم سيساهم لا محالة بشكل فعال في تخفيف العبء والضغط الذي كان ملقى على أعلى هيئة قضائية إدارية مما يتيح له التركيز على عمله الأساسي وجعله قادر على إتقان دوره الكامل في تقويم وصناعة الاجتهاد القضائي في المسائل الإدارية. This study aims to shed light on the role of second-instance courts in achieving balance within the Algerian judicial system by analyzing the various legal frameworks that regulate their functioning, clarify the scope of their jurisdiction, and highlight their importance in achieving balance with the judicial structure in the regular system. The creation of this new body is considered one of the most prominent developments that have affected the field of administrative judicial reform and an important step towards consolidating the idea of the state of right and law, especially since the presence of these courts will inevitably contribute effectively to reducing the burden and pressure that was placed on the highest administrative judicial body, allowing it to focus on His basic work and making him able to master his full role in evaluating and creating judicial jurisprudence in administrative matters. | |
