| dc.description.abstract | عرف المجتمع البشري ظاهرة الفساد منذ القدم و قد كانت عاملا أساسيا في انهيار أغلب الحضارات و الأنظمة، و قد استفحلت اليوم بالشكل الذي جعل أغلب دول العالم في معضلة لا يمكن الخروج منها إلا من خلال اتخاذ تدابير تشريعية صارمة للحد منها و تجنب مخاطرهاو هو ما سعت إليه تلك الدول بما فيها الجزائر؛ حيث تعد من بين الدول السباقة في المجال بسن ترسانة من النصوص القانونية في المجال و مع ذلك ما تنفك نسب هذه الجرائم من الارتفاع و لعل ما يجعل أخطارها و آثارها مضاعفة تبييض عائداتها و إضفاء صفة المشروعية عليها و هو الأمر الذي يشكّل تحديا أمام السلطات القضائية في كشفها و إثباتها الأمر الذي دفع بالمشرّع إلى تبني سياسة تمنع وقوعها في البدء لاسيما كجريمة ملحقة منصوص عليها في قانون الوقاية من الفساد و مكافحته بعدما نصّ عليها في إطار الشريعة العامة للجرائم.
