Abstract
The lease agreement is one of the most significant nominate contracts under Algerian civil law; it entails granting the lessee the right to use and enjoy a specific property for a defined period in exchange for a specified rent, thereby ensuring a balance between the interests of the lessor and the lessee. This contract is characterized as consensual, synallagmatic (bilateral), for consideration, and continuous in nature. Its essential elements include valid mutual consent, the subject matter (lawful use/benefit), a lawful cause, the term, and the rent. The contract imposes reciprocal obligations on both parties: the lessor is bound to deliver the leased property in a condition suitable for its intended use, to maintain it, and to guarantee the lessee’s undisturbed enjoyment of it. Conversely, the lessee is obligated to pay the rent, use the property in accordance with the agreement, preserve it, and return it upon the expiration of the lease. The lease may terminate upon the expiration of its term, by mutual agreement of the parties, through rescission due to a breach of obligations, or as a result of *force majeure* rendering performance impossible. Termination entails consequences such as the return of the leased property and the settlement of financial rights between the parties, alongside the possibility of claiming compensation for any damage sustained by either party. Through these provisions, the Algerian legislator seeks to ensure a fair balance between the rights and obligations of both parties, although practical application may sometimes give rise to disputes requiring judicial intervention.
