Abstract
غالبا ما ترتكز فعالية مكافحة مختلف الجرائم على مستوى السياسة الجنائية المقرّرة لتلك الجرائم ،لكن بالنظر لجرائم الهجرة غير الشرعية بالجزائر ،فإن الأمر يختلف لأنه رغم اعتبار أدوات السياسة الجنائية أحد الأجزاء المؤثرة في مكافحة هذه الجريمة ،إلا أن إرتباطها بمستوى التنمية والتفاوت في توزيع الدخل وفرص العمل و إنتشار الفقر ، يحتل الجزء الأكثر تأثيرا في عملية المواجهة ،فهي الجريمة الوحيدة التي لها خصوصية سواء من حيث طبيعة الجاني التي لا تتضمن لديه عوامل إجرامية كما في جرائم القتل والضرب ،أو من حيث طبيعة الأهداف التي يسعى لها هذا الجاني والتي تعتبر أهدافا مشروعة إلى الحد الذي يمكن إعتبارها حقوقا مفقودة ببلده يسعى الجاني لاسترجاعها في الدول المستقبلة ، لذا يبرز الارتباط بين مستوى العدالة الإجتماعية وتنامي مستويات جرائم الهجرة غير شرعية بالجزائر من جهة وكذا تأثير هذه الجرائم على مستويات العدالة الإجتماعية بالدول المستقبلة من جهة أخرى ، وهوما يدفعنا إلى تحديد مستويات هذا الإرتباط بالنظر إلى جملة من المؤشرات المحددة لمستوى العدالة الاجتماعية ، والذي تبين في نهاية البحث أنه كلّما قامت الجزائر بإرساء مؤشرات إيجابية للدلالة على وجود عدالة إجتماعية، إنخفضت نسبة الهجرة غير الشرعية ،وكلما زاد مستوى جرائم الهجرة غير الشرعية إلى الدول المستقبلة إنخفض مستوى العدالة الإجتماعية التي كانت سائدة لدى سكانها قبل بداية الهجرة إليهم .
The effectiveness of fighting crimes is often based on the level of the criminal policy set by the government. However, things are different as far as the illegal immigration crimes in Algeria are
concerned. Although the criminal policy’s tools are influential in the fight against illegal immigration, its relation to the level of development, disparities in income distribution, employment opportunities and the spread of poverty is far more influential in this operation. This crime is specific in comparison to the other crimes,
whether in terms of the nature of the culprit who possesses no criminal factors as in murder and beating, or in terms of the nature of his
objectives, which are legitimate for they reflect the rights he lost in his home country, and thrives to regain in the host countries. Therefore, we observe the link between the level of social justice
and the growing levels of illegal immigration crimes in Algeria, on the one hand, and the impact of these crimes on the levels of social justice
in the host countries on the other hand. This fuels our research endeavor to determine the levels of this correlation in the light of a number of social justice indicators. The present research showed that the more Algeria established positive indicators for the existence of social justice, the lower illegal immigration rates are. And the higher the level of illegal immigration crimes is in the host countries, the lower the level of social justice pre-existing the beginning of immigration get
