Abstract
تناولت هذه المذكرة موضوع الحماية القانونية للمنشآت الناشئة من الممارسات المخلة بالمنافسة، معتبرةً هذه المنشآت عنصرًا حيويًا في دعم الاقتصاد الوطني نظرًا لخصائصها. وفي ظل وجود قانون المنافسة، شهدت هذه المنشآت تطورًا ملحوظًا، إذ يوفر لها بيئة مناسبة تتيح لها فرصًا متساوية لمنافسة الشركات الكبرى، من خلال مكافحة المعوقات والممارسات التي تعيق نموها، كالتعسف أو غيرها من الممارسات المخلة بالمنافسة. ويتحقق ذلك من خلال إنشاء هيئة إدارية مستقلة تعمل على مراقبة الأسواق وكشف مختلف الممارسات غير العادلة التي تضر بالمنافسة الحرة وتؤثر سلبًا على المستهلكين، وذلك من خلال صلاحياتها الرقابية والتحقيقية. وبناءً عليه، تُتخذ الإجراءات القانونية اللازمة وتُفرض العقوبات المناسبة.This memorandum addresses the issue of legal protection for emerging enterprises from anti-competitive practices, considering these enterprises a vital element in supporting the national economy due to their characteristics. Under the Competition Law, these enterprises have witnessed remarkable development, as it provides them with an appropriate environment that allows them equal opportunities to compete with larger companies. This is achieved by combating obstacles and practices that hinder their growth, such as abuse or other anti-competitive practices. This is achieved through the establishment of an independent administrative body that monitors markets and exposes various unfair practices that harm free competition and negatively impact consumers, through its oversight and investigative powers. Accordingly, the necessary legal measures are taken and appropriate penalties are imposed.
