| dc.description.abstract | تتناول هذه الدراسة "المسؤولية المدنية لمحافظ العقارات" في ظل الإطار التشريعي الجزائري، نظراً للدور المحوري الذي يضطلع به هذا الموظف في تنظيم الملكية العقارية وضمان استقرار المراكز القانونية. ويهدف البحث إلى تسليط الضوء على الإطار المفاهيمي لمصلحة المحافظة العقارية وصلاحيات المحافظ، مع تقديم تحليل مفصل لعناصر المسؤولية المدنية الناشئة عن أخطاء التسجيل. وتخلص الدراسة إلى أن هذه المسؤولية ذات طبيعة مزدوجة: مسؤولية مرفقية (خطأ مرفقي) تضمنها الدولة، ومسؤولية شخصية (خطأ شخصي) يتحملها المحافظ بصفته الشخصية في حالات الخطأ الجسيم. وعلاوة على ذلك، يستعرض البحث الآليات الإجرائية المتاحة للطرف المتضرر، وفي مقدمتها دعوى الإلغاء ودعوى التعويض، وما يترتب على ذلك من حق للإدارة في ممارسة دعوى الرجوع. وأخيراً، تؤكد الدراسة على ضرورة تحديث النظام العقاري من خلال الرقمنة وتطوير قواعد المسؤولية، بما يضمن الموازنة بين حماية المرفق العام وحماية الحقوق الفردية.This study examines the "civil liability of the real estate registrar" within the Algerian legislative framework, given the pivotal role this official plays in regulating real estate ownership and ensuring the stability of legal positions. The research aims to elucidate the conceptual framework of the real estate registration service and the registrar's powers, while providing a detailed analysis of the elements of civil liability arising from registration errors. The study concludes that this liability is of a dual nature: institutional liability (service-related fault) guaranteed by the State, and personal liability (personal fault) borne by the registrar in their personal capacity in cases of gross negligence. Furthermore, the research reviews the procedural mechanisms available to the injured party—primarily actions for annulment and claims for compensation—as well as the administration's consequent right to exercise a recourse action. Finally, the study emphasizes the necessity of modernizing the real estate system through digitization and the development of liability rules, thereby ensuring a balance between protecting the public service and safeguarding individual rights. | |
