dc.description.abstractتعتبر الملكية المشتركة هي الوضع القانوني الذي يشمل مجموعة من العقارات المقسمة المملوكة بشكل مشترك بين عدة أشخاص، وتنقسم إلى حصص تشمل أجزاء خاصة ومشتركة للاستخدام الشخصي وأجزاء مشتركة كالسقف والجدران لا يجوز تقسيمها، حيث حرص المشرع على إعطاء الملاك حق الانتفاع. و الاستغلال والانتفاع دون الإضرار ببعضهم البعض كما بدأ في وضع أحكام وآليات لإدارة الملكية المشتركة، وهي الجمعية العامة التي يكون فيها الشركاء في مجموعة ويديرون جماعياً، أما المدير فهو الشخص الذي تعينه الجمعية كشخص احتياطي ونائب عن الشريك غير الموجود كما وضع المشرع حماية للملكية المشتركة بوضع قيود البناء قبل وبعد ذلك، كما أعطى لكل شخص مسؤوليته الخاصة عن الملكية المشتركة، إلا أنه حرص على ممارسة الإجراءات القانونية في حالة نشوء نزاع بين الملاك وفقاً لما ورد في .القانونJoint ownership is considered the legal situation that includes a group of divided properties owned jointly between several people, and is divided into shares that include private and shared parts for personal use and shared parts such as the roof and walls that are not permissible to be divided, as the legislator was keen to give the owners the right to use.
