| dc.description.abstract | يعد العقد الإداري الإلكتروني من أهم نتائج الثورة الرقمية الحديثة، فهو عقد يتم إبرامه عبر الإنترنت، وظهرت أهميته من حيث أنه لا يختلف عن العقد التقليدي، لأن كل منهما يتم إبرامه بواسطة اتفاق بين شخصين ويعبر كل منهما عن إرادته، بهدف تحقيق آثاره القانونية. العقد الإداري الإلكتروني لا يتطلب الحضور المادي للأطراف، فهو يتم بين غائبين، مما جعل الأمر أسهل وأسهل، وكان لانتشاره دور بارز في النشاط الإداري للمرفق العام. ونظراً لتزايد الطلب عليه والتعامل به، كان لا بد من إحاطته بحماية قانونية تتناسب مع طبيعته الإلكترونية، لذلك وضع الفقه آليات ووسائل إلكترونية حديثة لإثبات العقد الإلكتروني الذي أضاف إليه نوعاً من الخصوصية، وذلك حفظ وحماية حقوق المتعاملين معها، وزيادة الأمن والثقة، ومن أهم هذه الآليات التوقيع الإلكتروني، وكذلك المستندات الإلكترونية، وتتمتع هذه الوسائل الإلكترونية بنفس السلطة القانونية الممنوحة للمستندات الإلكترونية.The electronic administrative contract is one of the most important results of the modern digital revolution، as it is a contract concluded via the Internet، and its importance has emerged in that it does not differ from the traditional contract، because each of them is concluded by agreement between two people and both of them express their will، with the aim of achieving legal effects. The electronic administrative contract does not require the physical presence of the parties، as it takes place between absentees، which made it easier and easier، and its spread played a prominent role in the administrative activity of the public utility. In view of the increased demand for it and dealing، it had to be surrounded by legal protection commensurate with its electronic nature، so jurisprudence developed modern electronic mechanisms and means to prove the electronic contract that added a kind of privacy to it، in order to preserve and protect the rights of its dealers، and increase security and confidence، and the most important of these mechanisms is the electronic signature، Also، electronic documents، and these electronic means enjoy the same legal authority granted to electronic documents. | |
