Abstract
تناولنا في هذه الدراسة الموسومة بـ" :التفويض الإداري في التشريع الجزائري "بحثًًا قانونيا حول إحدى الآليات الإدارية المهمة التي تهدف إلى توزيع المهام وتخفيف العبء الإداري، دون المساس بمبدأ المشروعية. وقد تم تحليل الإطار المفاهيمي للتفويض، من خلال تعريفه، أنواعه، شروطه، وآثاره، مع التركيز على الجوانب القانونية والتنظيمية في التشريع الجزائري. كما تم التطرق إلى الأحكام الخاصة المتعلقة بالتفويض، طرق انتهائه، وتقييم فعاليته في الواقع الإداري، اعتمادا على المنهج التحليلي والوصف القانوني المقارن Entitled "Administrative Delegation in Algerian Legislation," we address a legal investigation into one of the important administrative mechanisms that aims to distribute tasks and reduce the administrative burden, without compromising the principle of legitimacy. The conceptual framework of delegation was analyzed, through its definition, types, conditions, and effects, with a focus on the legal and regulatory aspects of Algerian legislation. We also addressed the special provisions related to delegation, the methods of its termination, and an assessment of its effectiveness in administrative reality, relying on the analytical approach and comparative legal description.
