| dc.description.abstract | إن الحيازة وضع مادي يسيطر الشخص بنفسه أو بواسطة غيره سيطرة فعليه على سبيل التملك، فتجوز حيازة الحقوق العينية جميعا، سواء كان الحائز هو صاحب الحق أو لم يكن ،ولا يمكن حيازة الحقوق الشخصية والمعنوية، وقررت لها الحماية المدنية لدفع أي اعتداء يقع على الحيازة. وتنوعت دعاوى الحيازة بحيث انها تحمي الحيازة في ذاتها بصرف النظر عن ما إذا كانت تستند الى حق قائم قانونا أو لا تستند لذلك، و من ثم لا يطلب من رافع هذه الدعاوى إثبات أنه صاحب الحق وانما يكتفي بإثبات حيازته لهذا الحق ، وهي ثلاثة دعاوى، دعوى إسترداد الحيازة، ودعوى منع التعرض، ودعوى وقف الأعمال الجديدة، والحكم الصادر في جميع دعاوى الحيازة له حجية نسبية بالنسبة لدعوى الملكية لإختلاف موضوع كلى الدعويين. Possession is a material state in which a person or someone else exercises actual control over something, allowing them to have ownership. Possession of real rights is permissible, whether the possessor is the rightful owner or not. However, personal and moral rights cannot be possessed, and civil protection is provided to defend against any infringement on possession. There are various claims related to possession, which protect possession itself regardless of whether it is based on a legally established right or not. Therefore, the claimant is not required to prove ownership but only needs to demonstrate their possession of the right. There are three types of claims: a claim for recovery of possession, a claim for prevention of interference, and a claim for cessation of new actions. The judgments issued in all possession claims have relative validity in relation to ownership claims due to the difference in the subject matter of both claims. | |
