| dc.description.abstract | تتناول هذه المذكرة موضوع المؤثرات العقلية في التشريع الجزائري من خلال فصلين، خصص الفصل الأول لتأصيلها المفاهيمي والقانوني، حيث تم تعريفها وتمييزها عن المخدرات، مع بيان أنواعها وخصائصها، بالإضافة إلى تفكيك أركان الجريمة والجزاءات المقررة لها، سواء في صورتها الشخصية كالحيازة والاستهلاك، أو في صورتها العينية كالإتجار والترويج. بينما ركّز الفصل الثاني على السياسة العقابية والوقائية للمشرع، مبرزاً الآليات الردعية عبر القواعد الموضوعية والإجرائية التي تنظم عمليات التحري، المتابعة، والمحاكمة، ولم يغفل البحث الشق العلاجي والوقائي، حيث سلّط الضوء على دور مراكز إعادة التأهيل والدعم النفسي للمدمنين، إلى جانب دور مؤسسات التنشئة الاجتماعية كالأسر، المدارس، ووسائل الإعلام في الحد من انتشار هذه الظاهرة، لتختتم الدراسة بخاتمة تلخص النتائج والتوصيات المقترحة. This thesis addresses the issue of psychotropic substances in Algerian legislation through two chapters. The first chapter focuses on their conceptual and legal framework; it defines these substances and distinguishes them from narcotics, specifying their types and characteristics. Furthermore, it analyzes the constituent elements of the offense as well as the prescribed penalties, whether for personal offenses (such as possession and consumption) or material offenses (such as trafficking and promotion). The second chapter, meanwhile, emphasizes the legislator's penal and preventative policy, highlighting the deterrent mechanisms through the substantive and procedural rules governing investigation, prosecution, and trial. The study did not neglect the therapeutic and preventative aspects, highlighting the role of rehabilitation and psychological support centers for drug addicts, as well as the role of socialization institutions (such as families, schools, and the media) in combating the spread of this phenomenon. Finally, the study concludes with a summary of the results obtained and the proposed recommendations. | |
